The Banking, Business Financing & Creditors' Rights Practice Group at Greenbaum, Rowe, Smith & Davis LLP provides experience to institutional clients in virtually every type of financing transaction, whether complex or routine.  Attorneys in this Group are also highly proficient in all aspects of enforcement of creditors' rights and remedies, and the commercial litigation that financial institutions regularly encounter.  We also serve as a valuable legal resource to business clients of the firm in their transactions with banks and other financing sources.

The Group represents a number of the state's largest commercial lenders as well as insurance companies, leasing companies, non-traditional lenders and financial institutions of all sizes. Our services include counseling and assistance at all stages of the lending process from the issuance of a commitment to collection of the loan after default.  Our experienced attorneys have handled transactions secured by collateral ranging from real estate and business assets to ships and airplanes.  We recognize that the efficiency and responsiveness of attorneys are critical for our clients to prosper in New Jersey's competitive lending environment and we welcome the opportunity to work as part of the team to close deals or to "workout" troubled loans.

Our creditors' rights attorneys are well regarded by their peers. Schooled in the transactional practice, they bring a knowledgeable and experienced perspective to negotiation and litigation for the enforcement of our clients' remedies.  Clients often rely on our pragmatic approach and considerable experience with the debtor-creditor bar in achieving out-of-court resolutions to problem credits.  However, our attorneys will not hesitate to pursue clients' remedies of foreclosure, repossession and litigation, and we are active and well respected in the federal, state and bankruptcy courts.

The litigation attorneys in our Group have unique expertise in, and have been involved in a number of the leading cases decided in New Jersey pertaining to commercial paper and negotiable instruments. We have also represented financial institutions in a wide range of cases involving fraudulent activities such as embezzlement, forgery, check kites and mortgage fraud.  Our attorneys can also provide guidance and representation to clients who are conducting internal investigations or responding to investigations and regulatory inquiries from government agencies.

We carefully monitor current developments in this area of the practice and advise our clients of changes in the law, case decisions and commentaries that are pertinent to their business.  Our attorneys have published articles and are frequent lecturers on topics such as commercial paper, negotiable instruments and secured transactions and the intricacies and nuances of bankruptcy practice.

We are ever mindful of our clients' needs and goals. We offer efficiency and, when required, urgency in pursuing litigation strategies and handling financing transactions for our clients.  We also bring a creative and dynamic approach to enforcement of our clients' rights and remedies in and out of court, through negotiation, workout and litigation.
