Barry S. Goodman, Chair of the Real Estate Brokerage Practice Group at Greenbaum, Rowe, Smith & Davis LLP, and General Counsel to the NJ Association of REALTORS®, is the author of the book, 2011 New Jersey Real Estate Brokerage Law, which is published by New Jersey Law Journal Books. The book addresses key areas relating to real estate brokers, some of which are:
- Necessary disclosures to consumers;
- Requirements for contracts of sale and leases;
- Advertising rules;
- The unauthorized practice of law by brokers;
- Bases for broker liability; and
- Commission disputes and agency issues.
Mr. Goodman concentrates his practice in real estate and real estate brokerage issues, as well as antitrust suits, corporate shareholders’ and partnership disputes, and municipal law. Several of Mr. Goodman’s cases have resulted in published opinions that set precedents. For example, in a recent case, Reyes v. Egner (2010), the N.J. Supreme Court found that a real estate broker for a short-term summer rental was not liable to a tenant who was in the unit nine days and then fell where a step was higher than the construction code permitted and there was no required handrail. In addition, in Exit A Plus Realty v. Zuniga (2007), the Appellate Division decided that real estate listing agreements are not automatically void but only voidable based upon the equities of the case if a real estate licensee violates the Real Estate Licensing Act. Also in 2007, he prevailed before the N.J. Supreme Court in CBTR v. Twin Rivers Homeowners’ Association (2007), which held that homeowners’ associations’ policies regarding expressional activities will be upheld if they are reasonable but may be subject to constitutional scrutiny if they are unreasonable.
In addition to chairing the Real Estate Brokerage Group, Mr. Goodman is also a member of the Litigation Department, the Construction Law Group and the Community Association Group.
Mr. Goodman received his B.A. cum laude from Rutgers College and his Juris Doctor from Rutgers University School of Law, Newark. In 2010, he was honored by receiving the Middlesex County Bar Association Lawyer of the Year Achievement Award.
