I fully appreciate the importance of understanding the client’s business strategy and finding appropriate ways to implement it, rather than simply identifying the legal obstacles. Substantive law expertise and a constructive, life-affirming focus are an integral part of my client interactions and daily practice.
Mr. Flynn’s practice focuses on the environmental aspects of real property and business transactions, site remediation projects, environmental litigation management and avoidance, and compliance with environmental health and safety (EHS) regulations. In addition to providing guidance on environmental laws such as the Resource Conservation and Recovery Act (RCRA) and Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), Mr. Flynn’s experience encompasses environmental compliance and risk management associated with workplace safety and product stewardship laws including the Occupational Safety and Health Act (OSHA) and the Toxic Substances Control Act (TSCA), as well as related common law tort principles. He also assists solid waste service vendors obtain the required A-901 licenses and Certificates of Public Convenience and Necessity required under New Jersey law to operate within the state.
Mr. Flynn also counsels clients on corporate compliance related matters, including the development and implementation of effective compliance and ethics programs. His experience in this area includes drafting corporate compliance-related policies, training corporate employees on compliance-related requirements, investigation of corporate non-compliance allegations and due diligence reviews of third parties to assure compliance with the Foreign Corrupt Practices Act (FCPA).
Prior to joining the firm, Mr. Flynn served as Associate General Counsel at Celanese Corporation, where he provided legal assistance on general environmental, health and safety issues including clean air and clean water, waste handling and disposal, soil and groundwater remediations, environmental-related indemnity issues, and the litigation of regulatory enforcement, remediation cost recovery, contract indemnity and workers compensation matters. His in-house responsibilities also included oversight of the process for managing product-related risks, including applicable regulatory requirements and common law tort concerns, at key stages in a product’s development, along with the implementation of risk management measures to control those risks.
