Nothing makes me more proud than seeing the tangible results of working on real estate development projects. I work on all sorts of real estate matters, but it’s a great feeling to play a key role in a project I see rise from the ground to provide shelter, entertainment, employment and opportunity.  The satisfaction of having played a role in bringing that project to fruition never gets old.

Mr. Forshner concentrates his commercial real estate practice in the areas of land use, zoning, real estate development and redevelopment. He represents local, national and international developers, property owners and other business clients engaged in mixed use, residential, industrial, office, retail and affordable housing development projects.

Mr. Forshner provides sophisticated counsel and guidance across all phases of the project life cycle, including land use planning and approvals, permits and variances, appearances before municipal, county and state boards and agencies, and appeals of unfavorable land use decisions. Mr. Forshner's representation of clients encompasses a broad array of industries and includes significant expertise within the telecommunications and alternative energy (solar) industries. He has served as special land use counsel to various New Jersey municipalities and to the New Jersey Builders Association. 

Mr. Forshner regularly speaks on topics within the scope of his practice to a wide range of real estate, business and legal industry organizations. He has lectured on issues including those related to zoning and planning, redevelopment, affordable housing, sustainable energy, land use, eminent domain, transactional real estate, project financing and incentives, leasing, post-storm rebuilding, and attorney and governmental ethics.

Representative Matters

  • Obtained expedited approvals for the first phase of an approximately 700,000 square foot redevelopment project. The initial phase includes a warehouse/light manufacturing facility and the corporate headquarters for an internationally known bio-pharmaceutical company, and the relocation of major roads in this transit-oriented development. Two different rail lines are involved in the matter and the property is designated as an area in need of redevelopment. Subsequent phase(s) will include a redevelopment plan, potential tax abatement agreement(s) and additional development. The site included a major environmental cleanup from the former manufacturing facility.  State, regional, county and local approvals are necessary, along with the concurrence of the railroad companies.
  • Obtained approvals for a mixed use development, including live/work townhouses, rental housing (market and affordable housing) and retail/commercial uses in a redevelopment area. The project required a redevelopment agreement, creation of a condominium for sale of the live/work units, negotiated easements from the neighbor, as well as county and private road improvements.
  • Mr. Forshner was a member of the firm's team that advised an international Fortune 500 retailer with regard to millions of square feet of development in various locales, including redevelopment areas, tax abatement (PILOT) agreements, environmental remediation, redevelopment plans, state, regional, county and local approvals, zoning permits and certifications, miscellaneous agreements, construction permitting, and assisted in drafting leasing provisions.  
  • Represented a major utility company in all facets of land use approvals for a 14 MW ground mounted solar facility serving a Fortune 500 company.  Advised the client with regard to local, state, and regional approvals, including hearings, negotiation of easements and a developer's agreement, as well as addressing stormwater-related issues.
  • Represents clients, including the subsidiary of a Fortune 500 company and local renewable energy companies, in conjunction with land use approvals for solar energy projects in various locales throughout New Jersey
