The best part about litigation is the thrill of victory.  There aren’t many professions, other than professional sports, where you get to pour your heart into competing against an opponent and then have a neutral party decide whether you’ve won or lost.

Mr. Kolbenschlag focuses his practice in complex commercial litigation, white collar criminal defense, employment litigation, employment counseling, estate litigation, and significant injury personal injury claims.  

Mr. Kolbenschlag’s commercial litigation experience includes restrictive covenant cases, real estate and specific performance disputes, contractual litigation, banking litigation, partnership and shareholder disputes, fraudulent transfer claims, consumer fraud act litigation, professional liability litigation, estate litigation, construction litigation, defamation, construction and landlord/tenant matters. 

In the area of employment law, Mr. Kolbenschlag’s experience includes both employment litigation and counseling.  He defends claims of wrongful discharge, unlawful employment practices, discrimination, harassment, and wage and hour disputes.  He has represented clients in investigations and charges before the U.S. Equal Employment Opportunity Commission (EEOC) and New Jersey Department of Labor and Workforce Development.  He counsels corporate clients on a broad range of employment issues including termination, employee discipline, wage and hour, disability accommodation and requests for leave, and the drafting of employee handbooks.  Mr. Kolbenschlag regularly conducts Harassment Prevention Training Seminars for employees, management and human resource professionals.

Mr. Kolbenschlag’s practice also encompasses estate litigation including will contests and claims of undue influence. He also represents clients in personal injury and medical malpractice matters, including claims involving traumatic brain injuries, wrongful death, premises liability and alleged surgical, radiological, psychological and nursing malpractice, as well as the defense of catastrophic injury claims brought against the State of New Jersey.

Representative Matters

  • Was a key member of the firm's litigation team defending U.S. Senator Robert Menendez against criminal allegations of public corruption and bribery brought by the federal government.  The trial ended in November 2017 with a hung jury and subsequent mistrial.  Shortly thereafter, the Department of Justice dismissed all remaining charges against Senator Menendez.
  • Assisted with trial preparation and prepared direct and cross examinations for various witnesses in highly publicized six month trial of undue influence claim involving hundreds of millions of dollars
  • Successfully defended a major New Jersey University in an arbitration claim brought by a former employee alleging improper termination.
  • Negotiated a $750,000 personal injury settlement in a premises liability case and a $212,000 settlement in a dog bite case.
  • Successfully defended a significant insurance broker against claims of professional negligence in connection with a personal automobile policy.
  • Played a significant role in the representation of an attorney charged with professional ethics violations before the Disciplinary Review Board of the Supreme Court of New Jersey.
  • Negotiated a favorable settlement on behalf of a registered home improvement contractor in an action involving Consumer Fraud Act claims.
