David B. Farer, Co-Chair of the firm’s Environmental Department, will serve as the planning chair and moderator of the webinar “Environmental Insurance: Latest Development and Emerging Issues,” to be presented by the American Law Institute Continuing Legal Education (ALI-CLE) on Wednesday, November 3, 2021 from 1:00pm – 2:30pm. Ann M. Waeger, Of Counsel in the firm’s Real Estate Department, will join Mr. Farer as faculty for the presentation, which will also feature the insights of in-house counsel and risk managers, insurance brokers and other advisors.

The environmental insurance scene continues to evolve in an increasingly complex regulatory, transactional, development, and societal landscape. The marketplace is impacted by new insurance companies entering the market while others drop out, emerging issues and contaminants, changes in the underwriting process, and high-profile national and global microbial concerns such as the impact of bacteria and viruses such as the coronavirus pandemic.  

This program will examine the latest environmental insurance products and their expanding role in managing risk in transactional and development settings, in day-to-day operations in the business and manufacturing sectors, and in relation to a growing array of global environmental risks. The agenda will include:

Mr. Farer concentrates his practice on the impact of environmental laws on transactions and real property in New Jersey and around the nation. He has extensive experience related to the cleanup and redevelopment of contaminated properties including brownfields, environmental compliance and insurance issues, institutional and engineering controls, assessing and negotiating liability under federal and state Superfund laws, resolution of environmental issues in bankruptcy proceedings, litigation arising from those issues, and the field of sustainable development and green building. Mr. Farer has written and lectured extensively on environmental issues in New Jersey and nationally. He developed and chaired two long-standing ALI-CLE courses of study, including this recurring seminar on environmental insurance issues in the transactional and development settings.    

Ms. Waeger’s practice encompasses the purchase, sale and leasing of industrial and commercial real estate, the formation of business entities and the financing of industrial and commercial real property and business assets. She has a special focus on environmental issues in the transactional setting, including leases and agreements of sale, and the use of environmental insurance policies as a risk management tool. Ms. Waeger has written and lectured extensively on environmental insurance topics, serving as faculty for seminars presented by ALI-CLE, the New York State Bar Association, the American College of Real Estate Lawyers, the International Council of Shopping Centers and the Environmental Protection Agency, among others.
