Construction projects are all about risk and construction contracts are all about allocating that risk to the party best able to bear it. By developing and negotiating fair contract documents, I help my clients manage their risk and avoid disputes. When “shifting gears” is needed, though, I vigorously advocate for my clients in court or through the dispute resolution process. 

Mr. Nudelman concentrates his practice in construction law. For over 25 years he has represented members of the construction industry across a broad spectrum of matters. 

On the transactional side, Mr. Nudelman works with owners and developers, construction managers, general contractors, subcontractors and design professionals to prepare and negotiate contract documents for construction in the New Jersey and New York metropolitan area. Drawing on his experience with construction claims, Mr. Nudelman drafts, modifies and negotiates customized contracts, as well as contracts based on standard industry forms from groups such as the American Institute of Architects, ConsensusDocs and Design Build Institute of America. Mr. Nudelman also works with developers and owners to select the appropriate project delivery system, and then follow through with assistance in contract administration, and, if necessary, claims management.

Mr. Nudelman’s construction contracting work helps his clients manage the risk inherent in construction projects so they may adequately protect their interests now to avoid claims and disputes in the future.

When claims and disputes are unavoidable, Mr. Nudelman draws upon his wide-ranging experience in construction litigation, representing clients in state and federal courts throughout the New Jersey/New York metropolitan area, as well as in local and international mediations and arbitrations. He has defended and asserted claims on behalf of owners, developers, condominium associations, general contractors, design professionals, subcontractors, vendors and sureties involved in public and private construction projects. 

Mr. Nudelman has specific experience with claims and disputes involving change orders and extra work, construction defects, design and performance defects, errors and omissions/professional malpractice, building code violations, project management, delay and disruption, acceleration, liquidated damages, lost productivity, site conditions, warranties, project closeout, construction liens, municipal mechanic’s liens, condominium liens, payment and performance bonds, public contracting and violations under the New Jersey Consumer Fraud Act.

He has also represented clients who receive code violations lodged by state or local enforcement officials under the New Jersey Uniform Construction Code Act, defending them in proceedings in municipal court and before the Construction Board of Appeals and the Office of Administrative Law.

Mr. Nudelman has written numerous articles and spoken at national and local seminars about a variety of construction topics, including the AIA contract documents and the decennial changes, construction claims and defenses, ethics in construction project management and alternative dispute resolution.
