Steven Nudelman, Chair of the firm’s Construction Contracting & Risk Management Practice Group, will be a panelist for a presentation on “Trends in Construction Arbitration” at the New Jersey State Bar Association’s 2023 Annual Meeting and Convention. The program, cosponsored by the Construction Law and Dispute Resolution Sections, is scheduled for Wednesday, May 17 in Studio C of the Borgata of the Borgata Hotel, Casino & Spa in Atlantic City.

This program will provide some insights about construction arbitration and trends since 2022. Given the backlog in state court trials, construction cases have to wait years for a jury trial. In light of this delay, as well as the cost involved in preparing and trying such a case, parties are turning to arbitration (as well as other methods of alternative dispute resolution) in lieu of litigation. The panel, consisting of experienced construction attorneys and a senior executive from the American Arbitration Association, will address this trend and others, including, for example, how the arbitration process has changed since the advent of Covid-19, the increase/decrease in hearings, mediations before arbitrations, settlements, etc.                                           

Mr. Nudelman is a partner in the firm’s Litigation and Real Estate Departments, concentrating his practice in construction law. For over 25 years he has represented members of the construction industry across a broad spectrum of matters. On the transactional side, Mr. Nudelman works with owners and developers, construction managers, general contractors, subcontractors and design professionals to prepare and negotiate contract documents for construction in the New Jersey and New York metropolitan area. His construction contracting work helps his clients manage the risk inherent in construction projects so they may adequately protect their interests now to avoid claims and disputes in the future. When claims and disputes are unavoidable, Mr. Nudelman draws upon his wide-ranging experience in construction litigation, representing clients in state and federal courts throughout the New Jersey/New York metropolitan area, as well as in local and international mediations and arbitrations.
