Litigation partners Dennis A. Estis and Steven Nudelman, Contributing Authors of the New Jersey chapter of Construction Publication Inc.’s LienLaw Online, recently published a comprehensive 2013 update to the treatise. Mr. Estis is chair of the firm’s Construction Law Practice Group, of which Mr. Nudelman is a member.
Mr. Estis and Mr. Nudelman have co-authored the New Jersey chapter of LienLaw Online since 2001. The chapter has been updated to include the latest cases interpreting the January 2011 amendments to New Jersey’s Construction Lien Law. These cases, many of which are unreported, address the following issues:
- Construction Lien Law arbitration;
- Liens against leasehold interests;
- Stay of lien foreclosure action pending arbitration;
- Obligation of materials supplier to lien the proper project by a contractor with multiple, open accounts;
- Imposition of equitable liens when construction lien claim may not be asserted; and
- Explanation of monetary relief available to aggrieved party where lien willfully overstated.
LienLaw Online provides access to authoritative, up-to-date information on the lien laws of all 50 states and the District of Columbia. The website provides subscribers with a detailed overview of the rights, requirements and obligations of the lien laws of the various jurisdictions.
Mr. Estis concentrates his practice in complex litigation, particularly relating to construction, condominiums, general business disputes, alternate dispute resolution (ADR) and real estate. He has served as counsel to numerous developers, condominiums and cooperatives, several New Jersey municipalities, one of the major sewerage authorities in the state and a private school.
Mr. Nudelman counsels members of the construction industry in a variety of business disputes, including claims for breach of contract, negligence, professional malpractice, municipal mechanic’s and construction lien foreclosure, surety bond claims and Consumer Fraud Act violations. His clients include owners, contractors and subcontractors, design professionals and suppliers.
