Partner David A. Roth has been reappointed as chair of the Environmental Disclosure Committee of the American Bar Association (ABA) Section on Environment, Energy and Resources ("SEER"), effective June 2014.
Also in June, at the annual New Jersey State Bar Association (NJSBA) Environmental Law Section Forum, Maura E. Blau, Counsel, was appointed Chair of the Section, and Daniel Flynn, also Counsel, was elected to the Board of Directors.
Mr. Roth has a concentration in real estate, environmental, and health and safety law with special emphasis on compliance counseling and environmental aspects of real estate and business transactions. He assists clients in resolving issues arising under solid and hazardous waste laws, the federal Clean Water Act, the New Jersey Industrial Site Recovery Act (ISRA), the Toxic Substances Control Act, right-to-know programs, the Occupational Safety and Health Act and emerging product safety laws. A substantial part of his practice involves negotiating with and appearing before federal, state and local agencies in connection with enforcement actions, site investigation and clean up cases, permitting, voluntary agreements, and administrative consent orders, and handling administrative and judicial appeals. He also works closely with client EHS and legal departments on auditing, developing environmental management systems, and training with respect to compliance, reporting and disclosure requirements.
Ms. Blau counsels and assists clients on a broad range of environmental matters including contaminated site remediation and brownfield redevelopment projects, environmental assessments and due diligence related to complex real estate transactions and public-private partnerships, environmental compliance and air/water permitting requirements, underground storage tanks and other environmental issues. She has a longstanding interest and particular practice focus with respect to sustainable building initiatives, the use of alternative energy, and climate change issues. She closely follows related legislative and regulatory developments at the state, federal and global levels.
Mr. Flynn’s practice focuses on the environmental aspects of real property and business transactions, site remediation projects, environmental litigation management and avoidance, and compliance with environmental health and safety (EHS) regulations. In addition to providing guidance on environmental laws such as the Resource Conservation and Recovery Act (RCRA) and Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), Mr. Flynn’s experience encompasses environmental compliance and risk management associated with workplace safety and product stewardship laws including the Occupational Safety and Health Act (OSHA) and the Toxic Substances Control Act (TSCA), as well as related common law tort principles.
