Raymond M. Brown and Robert J. Flanagan III of the firm’s Litigation Department will lecture at a seminar on “Marijuana Business Law in New Jersey,” to be presented by the National Business Institute on Monday, December 10, 2018 at the Crowne Plaza Philadelphia-Cherry Hill, and on Wednesday, December 13, 2018 at the Saddle Brook Marriott. The seminar will run from 9:00am – 4:30pm at both locations.
The legalization of marijuana has created business opportunities, but it has also created many questions and uncertainties for professionals advising businesses due to the position of the federal government. What are possible federal responses to legalized cannabis? What types of businesses does state law allow, and how does a potential business owner obtain a permit? When are you potentially violating federal law by merely assisting a client?
Mr. Flanagan will focus on the topic of “Federal Responses to New Jersey Marijuana Law” from 9:00am – 9:30am. His presentation will address:
- Current Federal enforcement priorities
- Federal memos and contradictory messages
- Possible legal consequences to cannabis consumers under Federal law, including the Gun Control Act of 1968 and Federal Housing Assistance
- State agencies and Federal funding
- Preemption and the Controlled Substances Act
Mr. Flanagan concentrates his practice in litigation, including substantial work in all aspects of both state and federal civil and criminal litigation pre-trial, trial, and appellate practice. His experience is focused in the areas of banking and creditors’ rights, white collar criminal defense, landlord-tenant disputes, personal injury, community association law, and commercial litigation.
Mr. Brown will address “Ethics” during his presentation, which is scheduled for 3:30 – 4:30pm. Details will include:

- Duty to Pursue Justice
- Attorney use of cannabis products
- Attorney ownership of cannabis businesses
Mr. Brown concentrates his practice in white collar criminal defense, international human rights issues, internal investigations and complex commercial litigation. He has defended clients in state and federal courts and before administrative tribunals. He is a leading figure in the developing area of law related to the regulation and enforcement of business requirements for human rights compliance.
